Death of sole defendant led to dismissal of case
The death of Patrick Dameuve from Dieppe, the sole defendant prosecuted for the sinking of the "Mylanoh" off Cap d'Antifer, near Étretat on Feb 3, 2022, led to the dismissal of the case at the maritime court in Le Havre on Nov 6, 2025, The master of the 'Bienvenue' (IMO: 8590582) was scheduled to appear in court, charged with a failure to comply with the rules of the COLREG Convention or negligence on the part of the person improperly exercising command of the vessel, resulting in death, a charge he has always denied. For the families, there will be no further explanations. But he died in early September at the age of 69. The hearing lasted less than ten minutes. Civil lawsuits seeking compensation were expected to proceed. The accident had claimed the lives of two fishermen and a trainee from the Fécamp maritime high schoo, Thierry Bénard, 51, Hakim Hamitouche, 28, and Alan Fouache, 17. The BEAmer (Bureau d'Enquêtes et d'Analyses pour la Sécurité de l'Aviation Maritime - Maritime Investigation Bureau), in its investigation report, favoured the theory of a collision with another vessel, the ''Bienvenue'. The scallop dredger from Dieppe had alerted the CROSS Jobourg on the evening reporting an overturned hull 12 nautical miles off Cap de la Hève. The initial theory of a snag by the dredger seemed unlikely given the calm sea that evening.
