Prosecutor appealed with Supreme Court

Wed Jun 24 11:08:40 CEST 2026 Timsen

The Public Prosecution Service, responsible for appeals and cassation, filed an appeal with the Supreme Court regarding thea fatal collision between the 'Tiger' and the water taxi 'Stormloper' on the Wadden Sea on Oct 21, 2022. In 2025, the captain of the speedboat and the skipper of the water taxi were both sentenced by the court to community service and a suspended prison sentence of three months. However, the Court of Appeal ruled that the guilt of the speedboat captain could not be proven. On June 23, the Public Prosecution Service informed the lawyer for the victims, the next of kin, and the acquitted skipper about the decision to appeal to the Supreme Court. That decision had to be made within two weeks of the ruling. In the coming period, the Public Prosecution Service will examine which points were being challenged in the appeal to the Supreme Court and would assess whether that procedure would be continued. The Supreme Court examines whether a District Court or Court of Appeal followed the correct legal procedures. In this case, it concerned the Court of Appeal in Leeuwarden.

Captain of ferry acquitted on appeal after fatal collision with watertaxi

Thu Jun 18 10:13:45 CEST 2026 Timsen

The captain of the 'Tiger' has been acquitted on appeal on June 17. According to the Court of Appeal in Leeuwarden, it could not be proven that the defendant acted so negligently in the collision with the water taxi 'Stormloper' in the Schuitengat near Terschelling on the early morning of Oct 21, 2022, that he was guilty. The court had previously found Arco Z. guilty. He had appealed against a community service sentence of 240 hours and a suspended prison sentence of three months. The Court of Appeal was – contrary to the District Court – of the opinion that this part of the Schuitengat was a ferry route for which no speed limit applied. This meant that the defendant was not speedin. According to the Court of Appeal, he was also sailing on the correct side of the waterway. The skipper of the 'Stormloper' had previously received the same sentence from the court. According to the Court of Appeal, he was not sailing on the correct side of the waterway and at the time made a sudden steering movement to starboard side, causing the collision to occur. Without that maneuver, the collision would not have taken place.

Public Prosecution Service demanded community service and professional ban against captain of the Tiger for fatal collision

Thu Jun 04 10:56:20 CEST 2026 Timsen

The Public Prosecution Service demanded community service and a professional ban against the captain of the 'Tiger' for his role in the fatal collision with the taxi boat 'Stormloper' in the Schuitengat in Oct 2022. In the appeal, the man from Terschelling had actually requested an acquittal. Four passengers of the water taxi lost their lives in the incident. The 12-year-old Riemer was never found. In 2025, the captains of both vessels, a 36-year-old man from Harlingen and a 50-year-old man from Terschelling, were sentenced to 240 hours of community service. The man from Harlingen, who was operating the water taxi, agreed to the sentence. The captain of the 'Tiger' appeared before the judge again on June 3, 2026. The Attorney General read out the indictment on behalf of the Public Prosecution Service. The captain was accused of having acted “significantly negligently.” For instance, he allegedly sailed much too fast, at 55 kilometers per hour, whereas the speed limit in the Schuitengat is 20. Moreover, he communicated insufficiently and failed to yield the right of way. The defendant himself stated that he was wrongly convicted and therefore appealed. The Attorneys General blamed the man from Terschelling for the accident: The defendant made serious mistakes. As captain, he should have acted differently. Every passenger must be able to be transported safely across the Wadden Sea. The defendant sailed far too fast and was part of a culture: we decide for ourselves what is and isn't allowed on the Wadden Sea.” They demanded a suspended prison sentence of three months, a four-year professional ban from sailing as a ship captain, and 240 hours of community service. Lawyer Tjalling van der Goot, representing the captain, requested an acquittal for his client, as to his mind the reason the collision occurred was that the 'Stormloper' unexpectedly changed course and ended up in front of the 'Tiger'. At that point, there was no stopping it. The court will deliver its verdict in two weeks.
